This Personal Data Protection Policy explains how we collect and handle your personal information in accordance with the Malaysian Personal Data Protection Act 2010, which came into effect on 15 November 2013.

In the course of your dealings with Miragold, we may request that you provide data and information about yourself, your organisation, your employees and your customers ("Personal Data") to enable us to enter into commercial transactions with you or to deliver notices, services and/or products in connection with our business.

Personal Data collected may include, but is not limited to, your name, date of birth, identity card number, passport number, address, gender, race, contact information, e-mail address, residential or postal address, information about spouse and/or children, telephone or fax number, preferred mode of communication, credit card details, bank name and other banking information permitted by applicable law.

In accordance with Section 7(3) Personal Data Protection Act 2010, this Policy is issued in Bahasa Malaysia and English. In the event of conflict between both versions, the English version shall prevail.

Miragold Sdn Bhd menghormati dan komited untuk melindungi maklumat peribadi dan privasi anda. Polisi Perlindungan Data Peribadi ini menjelaskan cara kami mengumpul dan mengendalikan maklumat peribadi anda mengikut Akta Perlindungan Data Peribadi 2010 Malaysia yang berkuat kuasa pada 15 November 2013.

Sewaktu anda berurusan dengan Miragold, kami mungkin meminta anda memberikan data dan maklumat tentang diri anda, organisasi, pekerja dan pelanggan anda ("Data Peribadi") bagi membolehkan urus niaga komersial atau penyampaian notis, perkhidmatan dan/atau produk berkaitan perniagaan kami.

2. Kandungan Data Peribadi Yang Dikumpulkan

Data Peribadi yang dikumpulkan termasuk tetapi tidak terhad kepada nama, tarikh lahir, nombor kad pengenalan, nombor pasport, alamat, jantina, bangsa, maklumat hubungan, e-mel, alamat kediaman atau surat menyurat, maklumat pasangan/anak, nombor telefon/faks, kaedah komunikasi pilihan, maklumat kad kredit, nama bank dan maklumat perbankan lain yang dibenarkan oleh undang-undang.

3. Tujuan Pengumpulan Data Peribadi

Data Peribadi dikumpul, diproses dan digunakan bagi tujuan berikut:

• penyampaian notis, perkhidmatan, produk atau barangan penghantaran, termasuk pemasaran;
• membolehkan kemasukan ke dalam perjanjian/kontrak pembelian produk dan/atau perkhidmatan;
• penjagaan, penyelenggaraan rekod serta perkembangan pelanggan;
• memudahkan pembayaran produk dan perkhidmatan;

• pencegahan jenayah termasuk penipuan, pengubahan wang haram dan rasuah;
• pemenuhan keperluan undang-undang, peraturan, arahan, perintah mahkamah atau garis panduan berkaitan;
• penghantaran maklumat melalui e-mel, pos, panggilan telefon, SMS atau media sosial;
• khidmat pelanggan, program pelanggan setia dan perkhidmatan berkaitan;
• transaksi komersial lanjutan berkaitan produk dan/atau perkhidmatan kami.

Jika anda ingin menghentikan penghantaran bahan promosi/pemasaran, sila hantarkan e-mel atau surat kepada kami seperti dinyatakan dalam Klausa 11.

4. Sumber Data Peribadi

Data Peribadi diperoleh melalui saluran yang sah dan telus seperti:

• perjanjian/kontrak jual beli produk, hartanah atau perkhidmatan;
• borang pendaftaran rasmi bagi pelancaran produk dan acara promosi;
• borang permintaan maklumat yang diberi oleh kakitangan/ejen kami;
• e-mel/surat menyurat daripada anda;
• borang yang diserahkan melalui laman web kami atau laman web yang dikontrakkan;
• rujukan yang mempunyai maklumat hubungan boleh disahkan;
• pendaftaran buletin atau penerbitan promosi syarikat;
• kad perniagaan yang diberikan kepada kakitangan/ejen/broker/rakan sekutu;
• dokumen yang diserahkan untuk pemprosesan;
• penggunaan "cookies" semasa lawatan ke laman web kami.

Kami tidak akan sesekali membeli atau memperoleh Data Peribadi secara komersial melalui sumber yang tidak sah.

5. Hak Akses dan Pembetulan

Anda berhak untuk:

Maklumat yang dikumpulkan tidak dijual, diberi atau dikongsi untuk tujuan komersial. Data Peribadi boleh didedahkan kepada:

• syarikat berkaitan dan/atau subsidiari Miragold;
• rakan kongsi perniagaan/sekutu yang menyediakan perkhidmatan atau produk berkaitan;
• auditor, perunding, peguam, akauntan atau penasihat profesional;
• penyedia perkhidmatan pihak ketiga, syarikat pengurusan atau subkontraktor;
• penyedia perkhidmatan bagi program kesetiaan, penebusan hadiah dan perkhidmatan berkaitan.

Data Peribadi juga boleh didedahkan jika diperlukan bagi pencegahan/pengesanan jenayah, tujuan siasatan atau apabila dikehendaki oleh undang-undang/perintah mahkamah.

7. Pilihan Untuk Menghadkan Pemprosesan Data Peribadi

Anda berhak menghadkan sebahagian atau keseluruhan pemprosesan Data Peribadi dengan notis munasabah. Tanggungjawab pematuhan terletak pada Miragold sebagai pihak yang menentukan tujuan dan kaedah pemprosesan.

Anda boleh menarik balik atau meminda kebenaran pemprosesan, sepenuhnya atau sebahagian, tertakluk kepada sekatan undang-undang, syarat kontrak dan tempoh masa munasabah.

8. Kesan Keengganan / Kegagalan Memberikan Data Peribadi

Data Peribadi diberi secara sukarela, namun kegagalan memberikannya boleh menyebabkan:

• ketidakupayaan memuktamadkan transaksi jualan, kontrak dan/atau perjanjian;
• ketidakupayaan kami menyediakan notis, perkhidmatan dan/atau produk yang diminta;
• ketidakupayaan kami memaklumkan produk/perkhidmatan/pelancaran terkini kepada anda.

9. Perlindungan Data Peribadi

Data Peribadi anda disimpan dan diproses secara selamat. Perlindungan pentadbiran dan keselamatan yang sesuai dilaksanakan menurut undang-undang/peraturan berkaitan bagi mencegah akses tanpa kebenaran, pemprosesan tidak sah, kehilangan, kemusnahan atau kerosakan data.

Data elektronik disimpan dalam sistem rangkaian selamat, dengan akses terhad kepada pengguna dibenarkan sahaja. Pihak ketiga yang mengakses Data Peribadi anda juga tertakluk kepada tahap pematuhan yang sama.

10. Bahasa

Selaras dengan Seksyen 7(3) Akta Perlindungan Data Peribadi 2010, polisi ini dikeluarkan dalam Bahasa Malaysia dan Bahasa Inggeris. Jika berlaku percanggahan, versi Bahasa Inggeris akan diguna pakai.
